VPSGRID DMCA COPYRIGHT POLICY

This Digital Millennium Copyright Act (“DMCA”) Policy describes the procedures used by BLOCKSGENIE TECHNOLOGIES LLC, operating under the brand VPSGRID, for handling copyright infringement claims in accordance with the Digital Millennium Copyright Act (17 U.S.C. §512).

VPSGRID respects intellectual property rights and expects customers and users of its services to do the same.

2. Scope of Policy

This policy applies to all services provided by VPSGRID, including:

• Virtual Private Servers (VPS)
• Cloud infrastructure
• Networking services
• Storage services
• Customer-hosted content

VPSGRID acts as an infrastructure provider and does not actively monitor customer content.

However, VPSGRID will respond to valid copyright infringement notifications.


3. Copyright Infringement Notification

If you believe that content hosted on VPSGRID infrastructure infringes your copyright, you may submit a DMCA Notice of Infringement.

The notice must include the following information:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the infringing material and sufficient information to locate the material (such as IP address, URL, or server location).
  3. Your contact information, including:

• full legal name
• mailing address
• telephone number
• email address

  1. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  2. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  3. A physical or electronic signature of the copyright owner or authorized representative.

4. Handling of DMCA Notices

Upon receipt of a valid DMCA notice, VPSGRID may take the following actions:

• notify the customer hosting the content
• temporarily disable access to the infringing material
• request removal of the infringing content
• suspend the affected service if necessary

VPSGRID reserves the right to determine appropriate actions based on the severity of the complaint.


5. Counter-Notification Procedure

If a customer believes that content was removed or disabled by mistake or misidentification, the customer may submit a DMCA Counter-Notification.

The counter-notification must include:

  1. Identification of the removed content and its prior location.
  2. A statement under penalty of perjury that the content was removed due to mistake or misidentification.
  3. The customer’s:

• full name
• address
• phone number
• email address

  1. A statement consenting to the jurisdiction of the federal court in the United States.
  2. The customer’s physical or electronic signature.

6. Restoration of Content

If a valid counter-notification is received, VPSGRID may restore the removed content unless the original complainant files a legal action seeking a court order to restrain the customer from engaging in infringing activity.


7. Repeat Infringer Policy

VPSGRID maintains a policy for terminating accounts of repeat copyright infringers.

Customers who repeatedly violate copyright laws may face:

• suspension of services
• permanent termination of accounts
• refusal of future services


8. Misrepresentation

Submitting false DMCA claims or counter-notifications may result in legal liability.

Under U.S. law, any person who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorney’s fees.


9. Abuse of DMCA Process

VPSGRID reserves the right to reject DMCA notices that:

• do not meet legal requirements
• contain incomplete information
• appear fraudulent or abusive


10. Cooperation With Law Enforcement

VPSGRID may cooperate with law enforcement agencies regarding copyright violations where required by law.


11. Policy Updates

VPSGRID reserves the right to modify this DMCA Policy at any time.

Updated versions will be published on the VPSGRID website.

Continued use of services constitutes acceptance of the updated policy.
